PURPOSE OF THE PRIVACY POLICY
Diva Fashion S.r.l., a company registered in Italy (corporate register number , with registered office at Via Montenapoleone 21, 20121 Milano (MI), Italy, (“Filippo Gabriele”, “Company”) provides this Privacy Policy (“Privacy Policy”) to describe the way in which the company uses and processes all data collected via its Website at www.filippogabriele.com (the “Site”). This Privacy Policy does not apply to data collected offline or via sources other than this Site. This Privacy Policy applies exclusively to the Site and not to other Websites consulted by the User via links. The Data Controller is Diva Fashion S.r.l., and the data will also be processed by third parties as service provides chosen by Diva Fashion S.r.l.

TYPES OF DATA PROCESSED
The Company collects certain types of individual identifiable data via the Site (“personal data”) as well as other non-individual identifiable data via cookies and other tracking technologies (“data”). The Company collects only that personal data/data from the user that is necessary to provide its services. The Company guarantees that personal data is collected and processed in compliance with this Privacy Policy and applicable data protection legislation.
The submission of data to purchase products, subscribe to the newsletter, fill out online surveys, participate in promotions or otherwise actively send personal data to the Site is entirely optional. However, failure to submit data may prevent the provision of the services to which the data processing is related. Such personal data may include, as the case may be, name, e-mail address(es), invoicing address(es), delivery address(es), telephone number(s), payment card information, consumption type, lifestyle and product interest.

HOW CUSTOMER DATA IS USED
The Company processes personal data using electronic and traditional means primarily for the purpose in which the user initially provides them (e.g. to sell and deliver products, or to provide the requested newsletter) and to improve our products and services, and with the user’s optional consent, for market research and profiling. DATA DISCLOSURE AND SHARING
The personal data provided by users will be processed by Filippo Gabriele data processors and persons in charge of the processing as indicated in this policy and will never be disclosed. In compliance with applicable data protection legislation and with the user’s consent, Filippo Gabriele may share and receive, personal data with the group of companies affiliated with Filippo Gabriele, to allow Filippo Gabriele to inform the user of other products that may be of interest to him/her, improve his/her shopping experience and Site design. With the user’s consent, Filippo Gabriele may share personal data with its franchising network to manage customer relations (guarantee the same benefits to the customer worldwide), and for profile creation and marketing. After providing consent, the user may decide not to share his/her personal data with these affiliates and franchising network at any time, by contacting our head office at the address provided below.
The Company has contracts with select third parties that provide services for Site maintenance, customer communication management and other services. The following are the services provided by third parties: Site hosting, order preparation, anti-fraud control, order and return processing, payment processing, customer service, shipping and delivery, correspondence, and web marketing. The personal data collected via the Site may be consulted by these third parties exclusively on behalf of Filippo Gabriele. However, by law, these service providers may not use personal data for any other purpose. The Company may also disclose personal data to banks or other third parties for payment transactions. HOSTING AND DATA SECURITY
For Site hosting reasons, user personal data may be transferred outside the European Union to countries whose personal data protection legislation differs from that of the user’s country of residence.
When transferring data to these countries, Filippo Gabriele uses appropriate procedures to protect the user’s personal data from unauthorised access, use and disclosure in compliance with applicable legislation.

ACCESS AND CORRECTION
One of Filippo Gabriele’s data processors is the e-commerce director of Filippo Gabriele. Users may contact Filippo Gabriele for a complete list of data processors appointed by Filippo Gabriele and to exercise the rights granted pursuant to Article 7 of Legislative Decree no. 196/03 (personal data protection code)to interested parties. In particular, each user may: (I) receive confirmation of the existence or lack thereof of his/her personal data and be informed of it in an intelligible form; (II) be informed of the source of the data, the purpose and methods of processing and its means, and the logic applied to the processing performed using electronic means; (III) request updating, rectification or, where interested therein, integration of the data; (IV) obtain erasure, anonymization or blocking of data that have been processed unlawfully, and oppose their processing for legitimate grounds; (V) oppose any processing for the purpose of sending advertising materials, direct sales, market research and marketing communication.
Filippo Gabriele asks that since the user’s personal data is accessible to the user on the Site, the user keep his/her data accurate, up to date and complete by regularly updating his/her personal account.

DATA STORAGE AND SECURITY
Filippo Gabriele will store only the data necessary and for the period of time defined by applicable legislation.
Filippo Gabriele recognises that it is required to guarantee that the personal data collected via its Site be secure. The Site has security measures aiming to protect the user’s personal data held by the Company against loss, abuse, unauthorised access and alteration. Despite the implementation of security measures and adequate care of the user’s personal data, the user accepts the risk that data transmitted by internet and stored on a computer may be intercepted or consulted by unauthorised third parties.

EFFECTIVE DATE AND MODIFICATIONS
This Privacy Policy enters into force on 01 January 2018. Filippo Gabriele may modify this Privacy Policy from time to time. Should substantial modifications be made to it, the new version of the Privacy Policy will be published on the Site and a link on the Site’s home page will state “New privacy statement”.
We invite the user to check this Privacy Policy regularly, and in particular prior to providing any information. A new effective date will also be indicated at the top of this Privacy Policy.
