INTRODUCTION
General sale conditions for online purchases on FILIPPO GABRIELE site.
The company Diva Fashion S.r.l., with registered office at Via Montenapoleone, 21, 20121 Milan (MI), Tax-payer and VAT number 09853150960, offers for sale products of the collections by the brand Filippo Gabriele (hereinafter the “Product / s”) directly to its customers via this site www.filippogabriele.com (hereinafter the “Site”). These General Sale Conditions (“General Conditions” hereinafter) are regulated by the Italian Code of Consumption (Law D. Lgs. No. 206/2005), section II, Remote Contracts (art. 50 – 67) and by the laws in the field of e-commerce (D. Lgs. No. 70/2003).

GENERAL CONDITIONS
The “General Conditions” (hereinafter “General Conditions”) are an integral and essential part of the Site.
The customer is obliged to check and read these Terms and Conditions. General conditions in force are those published at the time the purchase order and are accepted on completion of the order.

CONSUMER INFORMATION
The Products available on the Website are shoes and fashion accessories.
The products and their prices in the Site constitutes an offer to sell to consumers only customer (hereinafter “Customer/s”). It defines the term consumer means any natural person who complete a purchase order for purposes outside their trade, business, craft or profession.
And the purchase of products on the Site ‘allowed only to users of age, over 18 (eighteen) years old.

PROCEDURE AND ORDER CONFIRMATION
To purchase one or more products, the customer must select the products of your interest, color and size. Items selected for purchase will be added to your cart. To have a chance to retain the items in your shopping cart in order to allow the continuation of purchase at a later time, the customer must first create an online account and register to that account at the time of purchase. You can buy without an online account/without registration, but all items included in the Cart will be deleted if the process is not completed and the customer will be required to start a new process when it comes back on the site at a later time.
The customer has the option to change any information stored by the same in the course of the purchase process until such time as confirmation of his order. Once the order is sent it is no longer possible for the customer to change or cancel the order.
The sale procedure will be considered completed only when the customer sends the purchase order to Filippo Gabriele by clicking the “Buy Now” at the end of your purchase confirmation page. To send the order the customer is required to provide your personal data, including name, address, email address and payment details. After having viewed and accepted these Terms and Conditions, including the details of the products, the details of shipping costs, the Privacy Policy and the conditions on the Right of Withdrawal will be considered concluded the purchase process.
Following the order, Filippo Gabriele will send the customer an email to confirm receipt of the order by Filippo Gabriele and its processing (hereinafter “Order Confirmation”). Customers can access their orders at any time from within the “My Account” on the site, if they have concluded the recording of your account on the site, or by contacting Customer Service at customerservice@filippogabriele.com.
Please note that the order confirmation does not constitute acceptance by Filippo Gabriele of the Customer. Filippo Gabriele accept the order and payment card the customer will be charged only after the shipment of products. At this point Filippo Gabriele;will send the customer a further confirmation email stating that the order has been accepted and that the products have been dispatched (“Dispatch Confirmation”). Filippo Gabriele reserves the right not to accept orders placed by the customer if it considers that these do not meet the requirements for sending a purchase order or those made by persons with whom there is an ongoing legal dispute concerning a previous order or for any other legitimate reason, without giving reasons.
For each product offered for sale on the Site, you will display an image of the product on the site, along with the unit price, the colors and sizes available. The images of the products are provided purely and solely for illustrative purposes. Filippo Gabriele assumes no responsibility for any inadequacies of the graphic representations of the products offered for sale on the Site.

AVAILABILITY
Products on the Site are subject to availability. Filippo Gabriele reserves the right to change at any time the availability, quantity and type the offer to sell.
Filippo Gabriele does not guarantee that the Products will always be available and invites the customer to check the availability of products offered for sale on the site at the time of purchase, the customer service customerservice@filippogabriele.com . The customer will be informed by email within 24 hours on the availability of products. If the products are not available, the payment card the customer will not be charged. If the amount of your purchase has already been charged, it will be granted a refund within fourteen (14) days to the payment card used to send the order.

Sending and confirming the purchase order the customer accepts and agrees to comply with these Terms and Conditions. If the customer does not accept any of the Terms and Conditions, should not send a purchase order for the Products on the Site.

PRICE AND PAYMENT
In the site the prices of products are expressed in Euros € and include VAT for countries outside the European Union, including Italy, and not inclusive of taxes or duties applicable to countries outside the European Union, including Italy.
Prices do not include shipping costs that will be charged separately during the purchase process. The shipping costs depend on the destination and the type of delivery selected during the purchase process and do not provide for payment of duties or taxes applicable to countries outside the European Union.
In countries which do not form part of the European Union subject to duties or other applicable taxes, shipping is done with the formula DDU (Delivery Duty Unpaid), which involves the possible payment to the carrier of such duties or taxes required by local authorities.
Filippo Gabriele accepts payments via Visa, American Express, Mastercard and PayPal.
The Products purchased will be sent to the customer only after the verification of the data relating to the payment card the customer, and only after receiving your debit authorization by the customer of the bank. The verification of data on the payment card may result in delays, but it will be reduced to a minimum and normally does not require more than 24 hours; but there may be more times. The payment card the customer will be charged only after the shipment of products.

DELIVERY
The products will be shipped to the address provided during the purchase process. For security reasons, Filippo Gabriele does not ship any order to a P.O. Box or accept any order where it is impossible to verify the identity of the recipient of the order and the address of the physical person.
All purchases will be delivered by courier service selected by Filippo Gabriele, DHL or TNT for the European Union and countries outside the European Union (hereinafter the “Courier”), unless otherwise expressly indicated. Orders will be shipped and delivered Monday through Friday to the exclusion of local or national holidays, after sending the customer the Dispatch Confirmation, based on availability indicated. Deliveries on the Sabbath may be available if proposals by Corriere. The conditions for delivery on the Sabbath day are indicated at the time of the offer.
For standard delivery, the estimated delivery times for Italy and the European Union are within 1-5 (one-five) working days from the Dispatch Confirmation, for all other destinations, countries outside the European Union lead times are estimated by 2-20 (two-twenty) working days from the Dispatch Confirmation. Filippo Gabriele not be liable for unforeseen delays and/or attributable exclusively to the Courier.
In the event that the customer does not receive the products within 7-10 (seven-ten) working days from receipt of the Order Confirmation, the Customer is advised to contact Filippo Gabriele at +39 02 76001700;or send an email to customerservice@filippogabriele.com .
Articles for pre-order will be shipped as they become available, as indicated on the Site when sending the order. The customer will receive a confirmation email of the shipment as soon as the order has been shipped and the delivery will be made within the same time provided for the other orders, depending on the type of delivery chosen.
If the parcel is not delivered for reasons dependent on the Customer (wrong address, the recipient always absent, incorrect number of telephone, etc.), or if the customer refuses delivery, the shipping charges and any customs fees will be deducted from refund due to the customer.

RETURNS AND RIGHT OF WITHDRAWAL
Customers have the right to terminate the purchase contract concluded with Filippo Gabriele, without penalty and without giving any reason, within fourteen (14) working days from the date of receipt of the Products purchased on the Site. By exercising the Right of Withdrawal Clients are not allowed to change your Product with another Product.
To exercise the right of withdrawal, clients are required to communicate to Filippo Gabriele intention to terminate the contract at customerservice@filippogabriele.com . In this case the customer must return the products in original condition “as new” to the headquarters of Filippo Gabriele.
The refunds will be paid to the Customer provided that the products have not been used, damaged, washed and are in the same condition in which they were delivered, equipped with the original tags attached, complete with all parts and accessories, and original packaging. If the customer exercises his right of return for all the products included in the same purchase order, all products must be made simultaneously with the same shipment.
Filippo Gabriele reserves the right to check the returned Products and refuse returns of Products that do not consider compliance with the requirements specified in paragraph 8.3 above.
Will be paid a full refund to the payment card used for the purchase as soon as possible and in any event within 14 (fourteen) days from the date on which Filippo Gabriele has confirmed for the first time receipt of returned products sent by the Customer, provided that those conditions in paragraph 8.3 have been met.
Delivery costs, and any customs charges for returned products are paid by the customer, and will be deducted from the refund due to the customer, unless otherwise indicated.
To return the products to Filippo Gabriele, customers should contact the Courier for the withdrawal of products that intend to return via courier from the residence or domicile in which they are the products. On the outside of the package must be affixed to the label for the return shipment that came with the package delivered. In addition, the customer must verify the presence of the label and the accompanying commercial documents of products inside the package and get a copy of the receipt for the return of the Products duly signed by the Courier, keeping it as proof of delivery.
If the customer chooses not to use the Courier Filippo Gabriele recommended that the customer will ensure the full value of the product to be returned, and obtain and retain carefully the shipping receipt and the invoice number.
Filippo Gabriele not responsible for reimbursement or compensation for those shipped products that have not been received from Filippo Gabriele as a result of loss, theft or damage not attributable to Filippo Gabriele.

ERRORS AND CHANGES ANNUITY CONDITIONS
Filippo Gabriele reserves the right to modify or correct these Conditions of Sale, the Privacy Policy, the terms of the Right of Withdrawal, the products offered for sale on the site and the prices of Products, at any time and without notice to the customer. Filippo Gabriele invites the customer to verify carefully the Terms and Conditions and Privacy Policy each time you use the site to make a purchase.
Filippo Gabriele will do its best to ensure that prices and other information about the products displayed on the Site are accurate and up to date. However, it may occasionally be present printing errors, misstatements or omissions (the “Errors”) relating to the description, price, and promotion, offers and availability of the products in question. Filippo Gabriele reserves the right at any time and without notice to Customer, to correct errors, to modify or update the information, to withdraw bids containing such error and cancel any order at any time prior to shipment.
If the payment card the customer is charged for a canceled order pursuant to section 9.2, the customer will be informed immediately by e-mail by Filippo Gabriele (in any case no later than 24 hours from the cancellation of the order) and a refund will be issued to the payment card the customer within 14 (fourteen) days from the cancellation of the order.

COMPLIANCE
The customer must check the products upon delivery to make sure that they correspond to those ordered.

WARRANTY AND RESPONSIBILITY

COMPETENT JURISDICTION
The right of the Italian Republic governs these Conditions of Sale and use of the Site by the Customer, and the Customer submits to the non-exclusive jurisdiction of the courts located in Italy for any measure arising from or relating to these Terms of Sale.
